Terms and Conditions for using The Social and Emotional Adjustment Scale (SEA Scale)

Thank you for using the SEA Scale. It is a 25 item questionnaire which assesses how a child makes and sustains positive relationships with peers and adults; how a child recognises, regulates and expresses emotions and how a child explores and engages with their environment.

Access to and use of the SEA Scale website and the information, materials and services are subject to all applicable laws and regulation, and to the Terms and Conditions below. By using and registering on the SEA Scale website you are agreeing to these terms and conditions, which are binding.

The SEA Scale website (sea-scale.org) is an initiative of The Mulberry Bush Organisation, a registered charity (number 309565) with its office at Abingdon Road, Standlake, Witney, Oxford, England, OX29 7RW  United Kingdom.

About your data

In accordance with current laws regarding data protection the SEA Scale website is compliant with the General Data Protection Regulations (GDPR) and our Privacy Policy.

The user of the website will retain a child’s identifying information and only the user can link this to a child’s unique SEA Scale identification number. It is the user’s responsibility to protect each child’s SEA Scale identification number. No individual child can be identified from any data entered onto the website.

Mulberry Bush Research will collect SEA Scale data for the purpose of research in order to further the development of the SEA Scale and influence practice within The Mulberry Bush Organisation and other schools, agencies and providers of care, education and treatment of vulnerable, traumatised children, young people, adults, their families and communities. All data used for research will be anonymised and not linked to any individual child, user or organisation.

Changes and updates to the terms and conditions

The SEA Scale is a new initiative and initially based on feedback from early adopters. These terms and conditions may not answer all your questions about the SEA Scale.  We may change these terms and conditions as necessary with or without notice to you, however the current version will be found on the SEA Scale website. Definitions  

We means The Mulberry Bush Organisation.

Administrator means an assessor who manages all the service users and all the data of an organisation. The administrator is responsible for buying and allocating credits on the account as well as setting up individual assessors.

Assessment means one SEA scale assessment.

Assessor means a person eligible to use or access information on the SEA Scale website as part of a subscription. 

Block of credits means an administrator buys 10 SEA Scale assessments. 1 block of credits = 10 SEA Scale assessments.

Data means any data inputted by an assessor.

Organisation means  an organisation or person who signs up and receives an account.

Redeem code means an assessor can enter a code and in return receive 10 free assessments for their organisation.

SEA Scale means the Social and Emotional Adjustment Scale. 

Service user means a user who is eligible to use the SEA Scale website and access data related to the credits purchased.  

Subscription means the rights to accessing the website and use the SEA Scale with the credits purchased or by redeeming a code.

Buying a block of credits

Purchasing a block of credits allows the organisation to carry out 10 new SEA Scale assessments. The administrator allocates the assessments to individual assessors.

Suspension and termination of accounts

We reserve the right to end your access to your user account if you breach any of these terms and conditions. We reserve the right to suspend your access at any time if we suspect that users from outside your organisation are using your subscription, or if we suspect that the registration details of users within your subscribing organisation are being used by anyone else.

If your user account is inactive for two years, we reserve the right to lock your account and archive your data. See the Privacy Policy for further details on how we handle and use your data.

Administrator and service user responsibilities 

Administrator

Each organisation must appoint an administrator. The administrator is responsible for registering an organisation and purchasing blocks of credits. The administrator must ensure that the details of the organisation and payment details are correct. It is the responsibility of the administrator to register assessors and to allocate credits to assessors. The administrator is also responsible for retaining a child’s unique identification number, and maintaining confidentiality of registration details, passwords and child identification details. The administrator may not allocate credits to anyone outside of their organisation. The administrator must comply with these terms and conditions.

Assessors

Assessors must maintain the confidentiality of a child’s identification number and the data entered onto the assessments. In addition they are responsible for keeping their registration details and passwords secure. Assessors must comply with these terms and conditions.

Service and website modification and discontinuation

We reserve the right at any time, and from time to time to update, edit, delete, suspend or discontinue, temporarily or permanently any or all of the website, and any information available through the SEA Scale website with or without notice. You agree that we shall not be liable to you for any such updating, editing, deletion, suspension or discontinuance. 

The cost for using the service is subject to change without notice, although this would not affect blocks of credits already purchased but not yet used. 

Warranties and liability

The SEA Scale is intended for use by a wide range of practitioners working with children. It is to be used to assess how a child makes and sustains positive relationships with peers and adults; how a child recognises, regulates and expresses emotions and how a child explores and engages with their environment. The information gathered will shed light on a child’s unique social and emotional development and needs to be considered in relation to the complex interplay of other social, cognitive and interpersonal factors. 

The SEA Scale and any associated materials should be used on an ‘as is’ basis and you agree to use these at your own risk. The SEA Scale is not a diagnostic tool, it is a measure to help practitioners assess and plan their interventions.

We disclaim the employees and representatives of The Mulberry Bush Organisation against any liability, loss, or risk arising directly or indirectly from the use and application of the SEA Scale and/or the website and service.

You irrevocably undertake not to make any claim against any Mulberry Bush employee or representative owner or contributing parties of or to the copyright or other intellectual property rights relating to the SEA Scale.

To the fullest extent permitted by applicable law The Mulberry Bush Organisation and representatives excludes any liability for losses and expenses of whatever nature and howsoever arising including any direct, indirect, special, punitive or consequential damages, loss of use, loss of dta, loss caused by a virus, loss of income or profit, loss of or damage to property, claims of third parties or other losses of any kind, even is we have been advised of the possibility of such damages or losses arising out of or in connection with the use of the SEA Scae and website. You assume total responsibility for establishing such procedures for your data backup and virus checking as necessary on all devices which you use to access the website or use the service.

Intellectual property

You acknowledge that we own the copyright in the SEA Scale and you agree that you shall not obtain any right, title or interest in or to the copyright or other intellectual property rights in respect of the SEA Scale.

Data protection consent

Any data inputted, stored and processed on the website will be handled according to our Privacy Policy.

Covid-19

The SEA Scale was written before Covid-19. We recognise that the items relating to
‘sharing toys and equipment with others’, ‘accepts touch’ and references to ‘peer groups’
might be more tricky in the current situation. Please answer all questions ‘as if’ we were
not in the context of Covid-19. The SEA Scale is looking at a child’s social and
interpersonal relationships so please bear that in mind and answer the questions to the
best of your ability.
